Comment: i am writing for my son who just last week committed suicide. he had primary physicalcustody of his 2 1/2 year old twins. he was married to a high school teacher. bio mother and her parents visited about once a month - bio mother married convicted child molester (he was 18 and girl was 12) spent time in jail and is now on probation. he is the father ofher 6 year old and she is 4 months pregnant. i (paternal grandmother) have been involved with babies since day 1 and want to maintain the status quo. on the day i buried my son, bio mom and grandmother showed up at my door and demanded the babies - told them they needed court order. my daughter in law and i have alread sought legal advice and we were told to sit tight and keep status quo - mother is probably eligible for legal aid and we are worried that she might seek emergency order. babies have been with my son for two years. any adivce. i am sick to think that they might be returned to her just because she is bio mother.

Comment: I was initially awarded joint custody of my two children then my ex wife sued a second time and i was out of money so she got full custody. I was ordered to pay a large amount (according to me) of child support - since then i have lost my job due to closure and now work for only minimum wages. My problem is that my ex-wife said she wanted no child support during the time i was not making a livable wage but she refuses to answer my phone calls or let me see the boys. Is there a counselor, lawyer, judge that i could speak with that could tell me how to lower my child support and make my ex let me see the kids.

I have no money left to pay my wife attorney. The judge hold me in contempt to purge, we aked him to rconsider but it was denied. I might go to jail till I pay however the judge still believes I have money to pay. My lawyer submitted a settelement to end this where the money for my wife and attorney will come from loans from family and friends. The wife came back if she agree she wants me to agree for her and the kids to move to ohio to get the extra support from her immediate family. I want this to end before my house goes to foreclosure. Comment: Please read the below and advise.Who is protecting the children, when the mother will not, the judge tries by the issuance of a court order, (one in which the child protection agencies in Hardin County Ohio and Lebanon County, Pennsylvania and the local police in the same localities will not enforce) and the father is prevented from it by the very same system that is designed to insure it.
Brian Kinter, filed for custody of his 3 children after their mother took them to Pennsylvania to start a new life with a man (Phillip Kerkhove) that they had taken into their home. Taking people in was nothing new for this family; there have been countless people that have benefited by their hospitality. Some might stay a day or two and others that have stayed for months at a time.
As one can imagine the heartache of a family separation. This not only affected this family but by all that know them.
The case was heard by District Magistrate Kathleen Lancaster on June 12, 2007
On June 11, 2007 Miss Boltz (mother) filed paperwork under oath through her attorney Ronald Tompkins stating that “Phillip Kerkhove had seen the strangeness of her and Brian’s life and basically rescued her”. Jenise goes on to say under oath “Brian has done this in retaliation of my filing for child support in Lebanon County Pennsylvania”.
Yet as to date Brian has never received or seen any paperwork to substantiate this claim.
June 12, 2007 First Hearing on the case.
Jenise states that Brian is under investigation by Champaign County Child Protection Agency (CCPA) for suspected sexual abuse of their daughter who is seven years old at the time and that the alleged incident took place about three to four years ago, but the mother has just recently found out about it.
Jenise also states that she was unaware that there was help available to her.
She then proceeds to state that she once stayed at project woman three or four years ago.
I don’t know about you the reader but to me this statement appears to contradict the preceding one.
July 9, 2007 Magistrates Decision and Orders are in from the June 12th hearing.
It states Ms. Boltz is restrained from having the children in the presence of Phillip Kerkhove and her step-father. Obviously the judge has her reasoning for making such an order, this causes Brian great concern and in essence Brian must do all he can to protect their children. And that Brian’s parenting time is suspended pending the findings of the CCPA”s investigation.
On July 17, 2007 Brian’s attorney Sanford Flack receives notification from the Champaign County Child Protection Agency that Brian, is not and has not been under any investigation as to the date of the letter.
In fact the first filing on this alleged sexual abuse was on the 20th of June in Lebanon Pennsylvania. This is eight days after it was presented in court.
Was this a lie? Would someone actually lie under oath?
In this hearing Jenise stated that she was receiving welfare from the State of Pennsylvania.
Did she report the fact that Phillip Kerkhove was residing with her and the children and providing income into the household?
I question this due to the facts that will later be revealed. If not I believe this constitutes welfare fraud. I question the same for the state of Ohio.
August third Brian’s attorney makes a request through Jenise’s attorney that Brian at least be allowed a supervised visitation or phone contact. The response “His client is following the court order and there will be no contact until the investigation is complete”. It has now been seventy days since Brian has even spoken to the children.
August 6th Court hearing on Guardian ad Litem. (G A L) His report appears to be very thorough and had raised several questions.
Ruling made that if Children Services determines that the alleged abuse is unsubstantiated that Mr. Kinter shall enjoy parenting time with the children.
Also states that a psychological examination will be of assistance.
Jenise is to bring the children to the family home at the conclusion of school on August 31st.
August 28, 2007 Jenise’s attorney files a motion to terminate the visitation.
Brian is subjected to these allegations of sexual abuse five times by three different Children Protection Agencies and three different police departments.
Each of them deriving at the same conclusion, that the allegations are unfounded.
Brian knows the truth, however he must prove it.
After the fourth allegation is raised, Brian requested a polygraph examination which, cleared him and thus will allow him to be able to once again to be able to enjoy time with his children.
August 31, 2007 Jenise’s attorney sends Brian’s attorney a fax stating that Jenise will be bringing the children to the Urbana Police Department, departing Pa. at the conclusion of school. Which should have arrival time around 11:30pm?
Brian travels to the police department and checks in with Officer Kizer at 11:10 pm
Brian waits until after 1 am. Jenise and the children never arrived.
Brian worries that they broke down or have been in an accident. He has no way to contacting them; he has never been given their new phone number.
No phone call from Jenise to Brian or the police department stating that they would be delayed.
September 1st Jenise and the children arrive at the family home accompanied by two officers from the Sheriff’s office. Brian is relieved.
It is later revealed that the children had no school on the 31st of August.
Jenise’s attorney files a response to the Guardian Ad Litem’s report
In Item # 6 Jenise states” Mr. Kerkhove cannot contribute to her as he must support himself”.
Was not this an attempt to defraud the court of the fact that she was not complying with the courts orders?
September 14th Brian travels to Pa. for his allotted time with the children.
September 16th Brian returns the children at 6pm. At 8pm Jenise calls Brian wanting to meet the following morning.
September 17th the meeting takes place. Jenise asks Brian if she can borrow $1,000 to move back to Ohio to make it easier on her and, the children would be closer to Brian.
Jenise signs a notarized agreement. It states Brian shall have free access to the children.
September 24th Jenise, children and Phillip Kerkhove (yes that’s correct the man that the children are not to be in the presence of) move to Hardin County Ohio.
October 5th Brian went to the elementary school to have lunch with his children. The principal advised Brian that Jenise requested to be notified if Brian came to the school because she was concerned that Brian would kidnap the children. (Wait he was not the one that took them 400 miles away.)
Brian was not able to have lunch with the children.
Wait Jenise signed an agreement that Brian was to have free access to the children.
Brian employs private investigators here in Ohio and the State of Pennsylvania to bring forth the truth, this costing him several thousands of dollars.
October 22nd Jenise becomes aware that Brian has retained the private investigator in Ohio. Brian obtains proof that Phillip Kerkhove is around the children.
October 23rd Brian notifies the Hardin County Child Protection Agency of the violation of the court order. The response it’s a civil matter they do not enforce the order. A call to the Kenton Police Department would bear the same results.
Brian’s questions who is protecting my children? Do they not see the ongoing damage being inflicted upon them?
October 24th Then on October 24th PI in Pa. was able to obtain reports from Daniel Keim, Christina Chadwick, Howard and Marie Chaney( all family members of Jenise’s) plus was able to speak with Jenise by phone.
This was the first time anyone in Jenise’s family knew she had moved back to Ohio.
During this investigation it was revealed that Jenise was in Pa. when she borrowed her son Thomas’s car and drove back to Ohio to pick Phillip Kerkhove up and take him out to Pa. to live with her and the children. (This contradicts what she had stated in court on June 12th) That Phillip Kerkhove had rescued her.
During his investigations all of the above with the exception of Jenise stated that Phillip Kerkhove had in fact been residing with Jenise and the children at Jenise’s sisters, from the time they moved into Chris’s until around the middle of September, (when they left to move back to Ohio funded by Brian) this in total violation of the court order.
Yet Jenise continues stating that Phillip Kerkhove has not been in the presence of the children.
On October 31,2007 her attorney filed a motion asking that Phillip Kerkhove be allowed to be in the presence of the children( why now Jenise has totally disregarded the court order since it was issued) and that he was supportive to Jenise emotionally and financially. (Wow this man is supportive to Jenise financially, yet owes more than $10,000 in back child support to his own daughter) Yet in terms of financially this is in contradiction as to what she had previously reported. In the documentation in this motion she states that Brian has been a source of irritation to school officials. Mr. Blechinger the principal reported that he has never had any problems or struggles with Brian signed an affidavit to such..
November 6th Brian called Hardin County Child Protection Agency again to see if they could perform a health & welfare check for the best interest of the children. He spoke with Cari Bowman he then called Pat Wainscott (the P I here in Ohio) and asked if he would place a call to this agency to inform them of the findings of his investigation. Brian faxed a copy of the court order to this agency.
November14, 2007 Brian called Hardin County Child Protection Agency at 9:59 am to inquire as to if they had done a health and welfare check. Miss Cari Bowman said he needed to speak with a Miss Claire Crates. Another allegation of sexual abuse has been raised. She said Brian was to call Champaign County Sheriff’s office and speak with a Detective Brown.
She could not tell Brian as to rather or not Phillip Kerkhove was residing there.
December 7, 2007 Depositions
Jenise stated that she has done nothing to prevent Brian from remaining an active part in the lives of the children. Actions speak louder than words.
At the depositions Jenise stated that she was aware of the court order clearly stating that Phillip Kerkhove was not to be in the presence of the children.
Faced with the overwhelming evidence Brian produces, Jenise finally admits that she has never complied with the courts orders.
I believe that it has become abundantly clear that Jenise has not honored any agreement or order since the beginning of this.
What does a father do when the mother continually shows the children that you can lie, connive, use deceit, and manipulate whoever, whatever, and whenever you want in order to pursue one’s own selfish desires?
There has been a civil case in Butler County Ohio where the mother was given 3 years for perjury. My understanding was the father pressed for prosecution under Ohio Revised Code 2921.22
I for one think it is about time that parent’s are held accountable for their actions.
I cannot comprehend how it is that lying under oath is viewed differently in a civil case verses a criminal case. A lie is still a lie and they can have long term affects on those injured by them. Thus charges of perjury should be brought forth.
The next hearing on the case will be heard on March 31st 2008 this is more than two months away.
It is my heartfelt plea that the court might find away to expedite this hearing in an effort to help minimize the ongoing damage being done to not only Brian but to the children as well.

I am actually having several issues with my childs mother but the main problem is the fact she plans on moving out of state and plans on taking my daughter with her <8months>. I have want to know what is the best course of action to stop this from happening. I am currently not on the birth certificate but she has said she is open to doing such & I also and not paying court ordered child support but I am paying her nevertheless. I am all for sole custodity but I realize that fathers rarely win those situations.

Comment: I am currently residing in the state of KS. My girlfriend recently had our baby daughter born 21 Feb, 2007. My problem lies with the Birth Cert. Comment: My wife is a teacher. She was teaching at a public school when she was offered a dream job at a very prestigious private school here in town. They hired her with th knowledge that she was pregnant. Their maternity leave policy is to offer short term disability insurance for female employees. However becasue she is already pregnant she cannot be covered by this insurance. I know there is no legal action that can be taken, but does anyone have any ideas on how to get this school to do the right thing and pay her for her maternity leave? Comment: Divorced 4 years and remarried. Live in PA. I am pursing shared custody of my daughter and my wife has filed for modification of our current support order which we agreed to at $500.00/month 3 years ago. She makes about 105K and I make about 90K and our 5 year old girl is in daycare ($800/month). I expect to lose and will have to pay around $1300/month. This will be a big hit for me as my current wife and I our pregnant and we are moving into a new home which we budgeted our mortgage based on the old support amount. I really just want to see my daughter more and am angry about how long (and costly) it takes me to try and get shared custody yet my ex-wife and file for modification and get it within a couple of months. I feel like a sitting duck waiting for the modification to increase and there is nothing I can do about it. Any thoughts out there from this group? Thanks for the help

My soon to be ex was in my house in slidell la. with my three kids.slidell is 30 miles from new orleans. the night of the 28th of august i was working down town phoenix for hunt construction co. at the new convention center. the same night of of the huricane i broke my leg on the job. the next day while going to get a cast put on my leg, i was sitting at a red light and was hit from behind by another truck running approx 60 mph.,so this left me with a flooded house, going through a devorce and no job.I sent all the money i had to my son, and to our still open joint bank account.only to have her depositing checks of mine in the account for deposit only ,written on the back then withdrawing it from atm. on dec 5-05 the community property was settled. she was awarded the house in slidell ,all contents and new vehicle.I had ins.on property and contents which she was awarded all ins.monies witch totaled over 100 k.she was also awarded 20k in annuities of mine. im paying 600 a month for child support and 630 a month for ins. and again i have not worked but two weeks since my devorce. to top it off she is currently working for her lawyer so now she is harassing me by serving me repeatedly so i will have to travel back and forth to la. How do i stop her from serving me on false pretenses. she wants all my bank statements after our comunity property was settled. and this is her cause for me to be served . Comment: What are the ramifications if any, if the father will not follow the parenting visitation schedule. It says in our decree that whoever has the children in there custody that it is that parents responsability to get the child or children to there sports or school activities. He is trying to refuse to do this due to the fact that he lives 120 miles away. We got lucky with the judge who use to be a footbal coach and finds this very important for the children. It does make it almost impossible for the father to have a normal visitation. As the stepfather I have tried to make this a good situation, it is truley impossible with this man. But for the childrens sake to let my ex wife and children live with us until my ex was able to get a job and find a stable place. So the kids could be in a stable home and school environment. So while she is staying with us we make her help with the bills.But she is not putting her priorites and children first . year she pays us money for the bills only because we bitch at her to. and instead for putting 50 dollars back out of her paycheck or helping when it comes to stuff her children need she blows her money left from her checks on herself there for not saving to get a place of her own . She is taking advantage of my fiance opening up her house to her and the kids. Comment: I am from a British Citizen and my wife is a US citizen and our 5 year old son (izzy) was born in London and has joint citizenship. I went to India with my wife and child (izzy) for 3 years on a project that was a joint business for me and my wife.
We have our home in London and everything in London is active (pay local taxes, doctors, Bank accounts, Doctors, power, Telephone etc). In India we have nothing but we rented a house and as our son was small we put him in an international school that was tied to the UK curriculum and our child was never emerged in the local culture as it was always European, even the head master was from the UK. We did not receive any wages either of us while we were there. We also never stayed longer than the 180 day that was needed for foreigners to register. We were to return home to the UK within the next few months.
I woke 1 day to find my wife and child gone and eventually found them in the US were I followed and kept in contact with the missing kid (US &UK) and eventually found. In the mean time my wife upon her return to the US (she is not resident in the US as she has not lived here for over 5 years and is a permanent resident of the UK) she filed a separation (as no jurisdiction for divorce) and took out a temporary custody order (but giving me access to my son but only with her father present).
My wife would not make contact and eventually through a 3rd party I was allowed to see my son and had to go to Oregon but of course there was a twist to this and it was to served to me the papers even though I had almost beg to have these served.
I went alone to the hearing date but it was stayed because I submitted a Hague petition which halted everything. My wife father then attempted to make a deal but I said no and a few days later I was offered to have my son the whole day without supervision…This is what I had dreamt of for the past 8 weeks. It happened and we spent the whole day together which was so emotional. Then the next day my wife and her father and myself met up to discuss our sons future which they wanted me to drop the Hague and live and work in the US even though I do not have a green card or anything then I would get to see him. Basically I refused and then they said if I now want to see Izzy I would have to go through the courts and get a supervision order with a 3rd party and then they left.
Because of the Hague it seems that I cannot ask the courts anything otherwise I am accepting jurisdiction but I want some how to change the temporary custody order so at least I can see him while I am in the US as I am only here waiting and waiting. They (and I use the word they) have already let me see him without supervision so they are not worried I will run off with him.
She is the one that abducted our son but it is my son and me that suffer and it’s at her whim what happens.
I feel like my son had died and now I have found him and he is 15 miles from me and I cannot even see him.
How can I appeal to the local family court to have at least some custody while I am here in the US?

Comment: my situation is this i have been going through my devorce for over a year now there are many D.H.S complaints from myself, neighbors,school system and even police. My children live in a discusting home they never have clean clothes they are told to make sandwiches while mom is eating meat and potatoes. mom is always on the computer the only attention they recieve is when she comes out of her room to yell at them. since i have had visitations i have treated them for headlice, ringworm,cuts and scrapes that have never been taking care of even by the school nurse telling mom to do so, they havent even been to the doctors since 10/24/2004 if this isnt abuse i dont know what is. they take one shower a week when i recieve them i need to put them immediatly in the shower and wash there clothes and sneakers. my children were recently sexually harrassed by a neighbor my 6 year old son was asked by this man how big his penus is and my 10 year old daughter was actually touched by this man. my concern is that i took all the right steps by calling the police, the gardian ad litum and youth alternatives and even filed a protection from abuse order they are all agreeing with me and on my side yet the state of maine does not seem to be complient with there job and leaveing my children in this very unsafe invornment. im stating to believe my children are going to end up seriously hurt (raped,beaten,kidnapped or even worse dead) all due to the fact that my ex wife does not take care of them. no supervision, love, happieness or protection considering she has called my children compulsive liers because my daughter told her about this insident and she chose to ignore it. im seriously wondering what exact actions i can take to ensure their saftey and get them home were they belong and will be safe and loved and nurtured. She is pregnant with my baby. I want to to be legally recognized as the father. I gladly pay child support. I am paying for a medical plan for her. I want visitation rights.
The parents of the expecting mom does not want anyone to know that I am the father. They already made plans to prevent the hospital to write down my name as the father. They will simply say, we do not know who the father is. The expecting mom will NOT deny the truth but feels coerced to please her parents.
What legal actions can I take before the birth to make sure the birth certificate lists me as the father?
Does the hospital will write down what the expecting mother says, or will the hospital believe what the parents say?

I recently moved outa state and now she told the children I am running from the law witch isnt true.I pay my support and caqll my kids on a regular basis and she puts me on intercom and the kids feel uncomfortable talking to me.
She has tried to make my wife look like a drunk and wouldnt let the kids be left alone with them.Her pastor send me emails saying I am a bad father and I called him and told him to stop saying bad stuff about me.

Recently I obtained custody of my fifteen (15) year old due to the fact that a child molestr has been living in the home. He molested my baby child who is now seven(7) years old. A couple of weeks later I had to go back to court. The judge finally awarded custody of the younger two(2) to me. It took a lot of praying by my wife and I along with help from a friend to finally make this happen. Now this convicted child preditor is walking free. The fiftenn(15) year old has warned that her mother asked her boyfriend to kill me. I know that this is a threat, but where do I go for help?

Comment: I am going through a custody battle over my two minor children, not with their mother but Their Uncles. My Ex and I separated after seven years together, when then she kept the kids with her and I moved out of town. I called the kids every other day and brought them back to stay with me for a week at a time about once a month. I would also come to see them at their house when ever I could. I sent cloths and toys and gave their mother cash when ever I could. There was never any child support set. About a year after my Ex and I separated she gave the kids to her Uncle without even telling me. When I found out they were with the Uncle I called, they said I was going to have to pay them child support, I told them no, that I was going to just come get the kids. I was also in the middle of a move at this time. The Uncle then told me no, its not about the money, he just wanted to make sure that the kids were taken care of in a loving environment, and that when I was able to I could come pick them up at any time. I told him as soon as I get into a place big enough I would come get them. He agreed. I went to the Uncles house to see the kids and to enroll them in school because the uncle was unable to. I also signed a paper giving TEMPORY care of the children, which included giving them permission to seek medical care if needed. At First everything seemed to be going well I called the kids, came to see them and the uncles even brought them to stay with me for weeks at a time. After Two months I was getting into a place that would be big enough for me to have my children. I called and said that we would need to start making plans for me to come pick up the kids. The Uncle then became very angry, he said no! And that if I ever wanted to see the kids again I would have to bring the police to his door. Which I did just that. But when the police and I were standing outside of the uncle’s house, they told me they could not take them out of the house unless they were in danger, that I would have to take them to court. I started to look into getting an Attorney but all wanted $1500 just to start the paper work. I could not afford this. I talked to the mother several times begging her to help me, all she ever said is that she would talk to the uncles and that it would change. during all this time The uncles cut off all of my calls with the children did not allow me to see them did not accept mail I sent to them, and even lied about what state they were in for a two week period. I continued to call even though they would never answer leaving messages telling my kids that I love them and miss them very much. I was able to talk to them one more time since all of this where my 6 year old little girl asked me “how come you don’t come see me anymore daddy, do you not love me” and I could hear the Uncle telling her what to say. This tore my heart apart!!!! The mother did not help, until now A YEAR later, because the Uncles have now cut her off. The Uncles told both of us that we could come see the kids if we gave them money and that we could not take them out of his house. I looked into legal assistance but when I called they said they could not help me because The Uncles have already talked to them. I know that they make too much money to get legal assistance but just because they talked to them it’s a conflict of interest. Now they Uncles are taking me and the mother to court for Custody of our children. We have already been to one conference in front of a Judge. Where now I am aloud to talk to my children on the phone and see them for four hours every other weekend until our next court date. The children are all over me when I come to pick them up I love them and they love me so very much! It is so hard for me when I have to take them back in only four hours. Please please if anyone can give me advice for when I go back to court anything will help, I can not afford an Attorney I am representing myself. Please email me.

Comment: I am really confused regarding my daughter, she looks and acts like my cousin more and more, I do not have a relationship with her, because of this, and her mother still will not give me a DNA test to put the issue to rest. I have spoken in the past to an attorney he wanted $5000.00 just to get the paperwork filed, He stated even if the DNA proved she is not mine the state ,still will not remove my name from her birth certificate, as they do not basterized a child. I was very young when all this happened, I did not know about the law or my rights at that time, making the state prove paternity. By all means if she is mine I would do my best to make up the time that was lost, but sadly I know in my heart she is not mine.
Is this true what the attorney stated, I do not mind going to court and paying for the cost of the fees, But I do not want to pay all this and find out she is not mine, and have to keep paying for a child that is not mine.
